TERMS OF SALE
These Terms of Sale govern purchases from Refab Blackout through refabblackout.com. By placing an order, you agree to these terms. Nothing in these terms limits rights that cannot legally be limited.
1. Custom tools and finish
Refab Blackout independently creates custom tools using genuine base tools. Each custom blackout finish is applied by hand, so minor variations in shade, texture, markings, and appearance are expected and are not defects. Product photographs represent the item or product style offered, but screens and lighting can affect color and appearance. Review each listing for whether batteries, chargers, accessories, or cases are included.
2. Independent business
Refab Blackout is an independent customizer and reseller and is not affiliated with, authorized by, sponsored by, or endorsed by Milwaukee Tool or its affiliates. Manufacturer names and marks identify the underlying products only.
3. Orders, pricing, and payment
Orders are offers to purchase and are accepted when payment is approved and we confirm the order. We may decline or cancel an order for suspected fraud, inventory errors, pricing mistakes, shipping restrictions, or inability to fulfill it. If we cancel after payment, we will refund the canceled amount. Prices, promotions, taxes, and shipping charges shown at checkout control. Promotion codes cannot be combined unless expressly stated.
4. Shipping and delivery
In-stock orders are normally prepared within 1–3 business days. Checkout delivery windows are carrier estimates, not guarantees. We currently ship only to eligible United States addresses using the method selected at checkout. If we cannot ship within the promised time—or within 30 days when no time was promised—we will provide any notice, cancellation choice, and refund required by law. Customers are responsible for providing a complete, deliverable address. Risk of loss does not pass to the customer until delivery.
5. Returns, damage, and order problems
Contact us within 14 days after delivery before returning anything. Approved returns are handled by mail. Discretionary returns must be unused, uninstalled, and in the condition received, with all included components and packaging. Because these are custom tools, used, installed, altered, abused, or personalized items are not eligible for discretionary return. We do not offer exchanges and do not charge a restocking fee. This does not affect remedies for an item that arrives damaged, defective, materially different from its listing, or incorrectly shipped. We pay reasonable return shipping for an approved seller error or qualifying defect; otherwise, the customer is responsible for the return label and return-shipping cost. Original expedited-shipping charges are nonrefundable unless required by law. After an approved return is received and inspected, we initiate the refund to the original payment method within five business days; the customer's bank or card issuer may require additional processing time.
6. Finish and warranty limitations
Unless a product listing expressly provides a separate written warranty, Refab Blackout does not offer an additional written product warranty. Customization, disassembly, or modification may affect or void an original manufacturer warranty; customers should not assume manufacturer coverage remains available. To the fullest extent allowed by law, products are provided without warranties beyond those expressly stated and any non-waivable implied warranties. Normal cosmetic wear, chips, scratches, chemical damage, misuse, improper storage, unauthorized repair, and ordinary battery capacity loss are not defects in the custom finish.
7. Safety and batteries
Power tools and lithium-ion batteries can cause serious injury, fire, or property damage if misused. Buyers must follow the original manufacturer’s safety instructions, use compatible chargers and accessories, inspect products before use, and stop using any damaged, swollen, overheated, wet, or recalled battery. Products are intended for lawful purchase and use by adults. Do not ship a return containing a lithium battery until we provide carrier and packaging instructions.
8. Limits of responsibility
To the fullest extent permitted by law, Refab Blackout is not responsible for indirect, incidental, special, punitive, or consequential losses, including lost profits, lost work, or replacement-tool costs. Our total liability arising from a product or order will not exceed the amount paid for that product. These limits do not apply where prohibited, including liability that cannot legally be excluded.
9. Misuse and resale
Customers may not use the site for fraud, unauthorized payment activity, unlawful resale representations, infringement, interference with site operation, or attempts to bypass purchase limits. We may cancel suspicious orders and preserve information reasonably necessary to prevent fraud or comply with law.
10. Governing law and disputes
South Carolina law governs these terms, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, disputes must be brought in a court with jurisdiction in Greenville County, South Carolina. Before filing a claim, please contact us and allow 30 days to attempt an informal resolution.
11. Changes and severability
The terms posted when an order is placed apply to that order. We may update these terms prospectively. If any provision is unenforceable, it will be limited or removed only as necessary, and the remaining provisions will continue.
